OUI: After the Arrest

This training course begins with a refresher on fatal crash investigations and guides officers through the critical post-arrest phases of an OUI case. With OUI offenses being among the most litigated, officers must be prepared to defend their actions from chemical testing to courtroom testimony. This course focuses on helping officers conduct constitutionally sound investigations and present themselves effectively on the stand. Through interactive discussions and mock testimony exercises, attendees will gain the skills needed to navigate both direct and cross-examination with confidence.
Sponsored by the Maine Bureau of Highway Safety, this class will review impaired driving investigations including: the initial stop, chemical testing, testifying in court and BMV. This course puts a significant focus on drug impairment (especially Cannabis and Opiates).
Course Objectives:
- Review the legal and procedural requirements for first response at fatal crash scenes.
- Understand constitutional considerations and proper procedures for obtaining chemical tests post-arrest.
- Improve report writing to ensure clarity, completeness, and courtroom readiness.
- Prepare and deliver effective direct testimony in OUI cases.
- Develop techniques to remain professional and credible under cross-examination.
