Instructional Goal:
This course is intended to provide correctional officers with a very basic understanding of the legal rights of convicted prisoners and pre-trial detainees. These rights arise primarily from the United States Constitution and from statutory enactments of the United States Congress, including the Americans with Disabilities Act, and the Maine Legislature. This course also provides correctional officers with an overview of the common law, the federal and state court systems, and the nature of lawsuits by incarcerated people.
Performance Objectives:
After this unit of instruction, the student will be able to:
- Identify the 4 Amendments of the Constitution that most impact incarcerated individuals and the key elements of each Amendment.
- Identify the 5 standard steps required by due process.
- Demonstrate an understanding of how to balance security concerns with the protection of the rights of incarcerated people.
- Apply the principles of the ADA and religious accommodations to ensure appropriate treatment of incarcerated individuals.
- Analyze and evaluate situations where constitutional rights may be at risk in correctional settings.
- Assess the impact of legal obligations on the roles and responsibilities of corrections officers.
- Examine case studies and identify instances where incarcerated peoples’ rights were violated or protected.
- Assess the implications of violating or neglecting constitutional rights in correctional facilities.
- Critically analyze the role of corrections officers in promoting a constitutionally compliant and respectful environment.
